Legal notice

Who runs swap.samsam.lol, what it actually does, and who is responsible for what.

§ 1 — operator

Information under § 5 of the German Digital Services Act (Digitale-Dienste-Gesetz, DDG). swap.samsam.lol is run privately, not commercially, by a private individual resident in Germany.

§ 2 — contact

Email is the only contact channel. There is no phone number and no support desk. A human reads the inbox, usually within a day or two.

§ 3 — what this site is, stated plainly

swap.samsam.lol is a comparison and order interface. It asks third-party swap providers what they would give you for a pair and an amount, shows you the answers side by side, and — if you pick one — hands your order to that provider and shows you its deposit address and status.

That is the whole service. Specifically, this site:

  • never takes custody of your funds. No coin you send ever touches an address this site controls. You send directly to the provider, and the provider pays out directly to the wallet address you entered;
  • is not an exchange and does not operate one. It executes no trades, holds no order book, and sets no rates;
  • is not a wallet and holds no keys, seed phrases, or balances of yours;
  • gives no investment advice. Nothing here — the offer list, the sort order, the price converter, the charts — is a recommendation to buy, sell, or hold anything. Prices shown are indicative and move;
  • does no KYC and no identity checks. Whether identification is required is entirely the selected provider's decision, made under its own rules, and it can be asked for after you have already sent funds.

The provider you choose is your counterparty. Its terms, its rates, its refund policy and its compliance requirements govern the swap. If a swap goes wrong, the provider is who can fix it; this site can only tell you what it was told.

§ 4 — responsibility for content

The operator is responsible under § 7(1) DDG for the site's own content, judged by general law. Under §§ 8 to 10 DDG there is no obligation to monitor transmitted or stored third-party information, or to investigate circumstances suggesting unlawful activity. The duty to remove or block content under general law is untouched by that, but it starts at the point a concrete infringement becomes known. If one is reported, the content comes down promptly.

Offers, rates, coin lists, network names, minimum amounts and order statuses shown here are supplied by third-party providers and price sources, in real time. They are passed through without independent verification. They can be stale, wrong, or briefly absurd.

§ 5 — responsibility for links

This site links to external pages it does not control, so it cannot be liable for their content — that always rests with the operator of the page linked to. Linked pages were checked for obvious infringements when the link was added, and none were apparent. Ongoing monitoring without concrete evidence of an infringement is not reasonable and is not done. Report a bad link and it will be removed.

§ 6 — copyright and trademarks

The site's own text, layout and code are protected by German copyright law. Coin names, network names, provider names and logos belong to their respective owners; they appear here to identify what is being swapped and by whom. Their appearance is not sponsorship, endorsement, affiliation, or any suggestion that those companies operate this site.

§ 7 — consumer dispute resolution

No link to an online dispute resolution platform is provided here.

The operator is neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board (§§ 36, 37 VSBG). The general information duty in § 36 VSBG applies to businesses with more than ten employees; this site has none. Disputes are handled by email first, and by the ordinary courts if that fails.

§ 8 — disclaimer

This is a hobby project, run by one person, offered as it is and with no guarantee of availability, correctness, or that any given swap will complete. Crypto transactions are irreversible. A wrong address, a wrong network, or an amount below a provider's minimum can destroy the funds involved, and no one — not this site, not the provider, not the operator — can undo that. Check the address and the network before you send anything.

Liability is limited to intent and gross negligence, except where German law does not permit that limitation, namely for injury to life, body or health and under the Product Liability Act. Nothing in this notice restricts your statutory consumer rights against the provider that actually executes your swap.

Whether you may use a swap service at all, and what you owe in tax on the result, depends on where you live. That is your responsibility to know, not this site's to check.
